Attorney General Urges Court to Reject Adu Boahene’s No-Case Submission
Kwabena Adu Boahene, former Director of the National Signals Bureau (NSB), and his co-accused have been urged by the Attorney General to answer the charges against them, with the prosecution asking the High Court to dismiss their no-case submission. In a 25-page written argument, the Attorney General maintains that witness testimonies and documentary evidence establish the essential elements of the 11 financial charges against Adu Boahene, his wife, Angela Adjei Boateng, and Advantage Solutions, a company allegedly owned by the couple. They are standing trial over the alleged diversion of GH¢49.1 million intended for the purchase of cybersecurity software for the state. Adu Boahene filed the no-case submission on September 25, arguing that the prosecution had failed to establish sufficient grounds to require him to open his defence.
The prosecution called four witnesses, including NSB Head of Finance Ruby Adumoah Opoku, who testified about the transfer of GH¢49.1 million from the bureau’s account to an account unknown to the institution. Other witnesses described cash transactions allegedly carried out on Adu Boahene’s instructions, the operation of a company used to move funds, and accounts investigators said were created to divert the money. An Economic and Organised Crime Office investigator also challenged the authenticity of a letter purportedly confirming the software purchase. The Attorney General argues that cross-examination by the defence did not undermine the prosecution’s essential evidence and has asked the court to require the accused persons to present their defence. The court is scheduled to rule on Thursday, November 5, 2026. Its decision will determine whether the accused must open their defence or are acquitted at this stage; dismissing the no-case submission would not amount to a finding of guilt.
